Appellate Advocacy

The simple truth is that the majority of appeals are probably going to be decided on the basis of established precedents and facts, without regard for the skill of the various lawyers presenting the case on appeal. In some cases, however, the rule of law and thus the decision may be a close call, and could therefore hinge on the quality of appellate advocacy. Appellate advocacy differs significantly from trial advocacy, and a good trial lawyer may not be a good appellate lawyer. In the appeals process, writing is absolutely crucial. Oral argument is severly limited, often to only a few minutes, and the appellate case is presented almost exclusively in writing. The appellate outcome may hinge on the lawyer's ability to draft a coherent and persuasive brief. Similarly, the lawyer must know exactly which issues to discuss during the short oral argument, and must be able to address any questions the appellate court may present during that time.
